As an employer you have overall responsibility for health and safety within your business to keep your employees’ safe and their training up to date. It is a legal obligation to have a Health & Safety policy and to have undertaken a risk assessment, which must be written down if you employ 5 or more people. Failing to address health and safety issues can result in injuries and illness to your staff, penalties for non-compliance including fines, imprisonment and reputational damage.

In the UK *

In 2013/2014 new cases of work related illness and injuries cost £14.3 billion
27.3 million working days were lost due to work related injury or ill health in 2014/2015
Fines for Health & Safety convictions are now unlimited

Autumn 2016 Update

As many £1 million or larger penalties have been given within the last 6 months (since the new Guidelines came into effect) as in the previous 20 years
Courts must assess the potential for harm when there is a breach rather than just the actual harm caused
Fines are now linked to the turnover of the company – if the same breach/risk found for two different companies but one has a low turnover while the other very high, the penalty can greatly increase.
The Guidelines are also likely to lead to more custodial sentences as judges assess culpability, degree of actual harm, likelihood of harm and whether more than one person was exposed to risk when determining a sentence
